Terms and Conditions for EkaLoveYa, the LMS website operated by CADUCEUS WEBY TECHNOLOGIES LLP:

  1. Introduction

Welcome to EkaLoveYa, the online learning platform operated by CADUCEUS WEBY TECHNOLOGIES LLP. These terms and conditions (“Terms”) govern your use of the EkaLoveYa website, including all courses and content available on the website.

By using EkaLoveYa, you agree to these Terms. If you do not agree to these Terms, please do not use EkaLoveYa.

  1. Intellectual Property

EkaLoveYa and all content available on the website, including without limitation text, graphics, logos, images, audio clips, video clips, data compilations, and software, is the property of CADUCEUS WEBY TECHNOLOGIES LLP or its licensors and is protected by Indian and international copyright and trademark laws.

You may not use any of the content on EkaLoveYa without the express written consent of CADUCEUS WEBY TECHNOLOGIES LLP.

  1. User Accounts

To access some features of EkaLoveYa, you may be required to create a user account. When creating a user account, you agree to provide accurate, current, and complete information about yourself. You are responsible for maintaining the confidentiality of your user account login information and for all activities that occur under your account.

  1. Instructor Accounts

Instructors who wish to create courses on EkaLoveYa must create an instructor account. When creating an instructor account, you agree to provide accurate, current, and complete information about yourself and your qualifications to teach the courses you create. You are responsible for all content you post on EkaLoveYa and for all activities that occur under your instructor account.

  1. Course Creation

Instructors may create courses on EkaLoveYa subject to the following terms:

a. Course Content: You are solely responsible for the content of the courses you create. You represent and warrant that your courses will not infringe the intellectual property rights of any third party.

b. Pricing: You may set the price for your courses, subject to the pricing guidelines set forth by EkaLoveYa. You may not charge for any courses that infringe the intellectual property rights of any third party.

c. Revenue Sharing: You will receive a percentage of the revenue generated by your courses, as specified by EkaLoveYa. EkaLoveYa reserves the right to change the revenue sharing percentage at any time.

  1. Course Access

If you enroll in a course on EkaLoveYa, you agree to the following terms:

a. Course Access: You may access courses on EkaLoveYa for the fee specified by the instructor. You may only access the course for the duration specified by the instructor.

b. Payment: You agree to pay the fees for the courses you enroll in, as specified by the instructor. You are responsible for all charges associated with your account.

c. Refunds: If you are dissatisfied with a course you have purchased, you may request a refund within the refund period specified by the instructor. Refunds will be issued in accordance with the instructor’s refund policy.

d. Content Usage: You may access the content of courses solely for your own personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the content on our LMS, except as follows:

i. Your computer may temporarily store copies of such content in RAM incidental to your accessing and viewing those materials.

ii. You may store files that are automatically cached by your Web browser for display enhancement purposes.

iii. You may print or download one copy of a reasonable number of pages of the Site for your own

7. Payment and Fees
a. Fees: You agree to pay all fees associated with your use of EkaLoveYa, including without limitation the fees for any courses you enroll in. The fees for each course will be clearly displayed on the EkaLoveYa website.

b. Payment Methods: You may pay for courses using any of the payment methods specified on the EkaLoveYa website. EkaLoveYa may add or remove payment methods at any time.

c. Refunds: If you are dissatisfied with a course you have purchased, you may request a refund within the refund period specified by the instructor. Refunds will be issued in accordance with the instructor's refund policy.

d. Taxes: You are responsible for paying all applicable taxes associated with your use of EkaLoveYa.

e. Payment Disputes: If you have a dispute regarding a payment made through EkaLoveYa, you should contact EkaLoveYa customer support. EkaLoveYa will work with you to resolve the dispute, but reserves the right to suspend or terminate your account if the dispute cannot be resolved.

f. Late Payment: If you fail to pay any fees when due, EkaLoveYa may suspend or terminate your account.

g. Revenue Sharing: Instructors will receive a percentage of the revenue generated by their courses, as specified by EkaLoveYa. EkaLoveYa reserves the right to change the revenue sharing percentage at any time.

8.Instructor Terms
If you are an instructor who creates courses on EkaLoveYa, you agree to the following terms:

a. Course Creation: You are responsible for creating and maintaining the content of your course. You agree to provide accurate and complete information about your course, and to keep that information up to date.

b. Course Fees: You may set a fee for your course, subject to the approval of CADUCEUS WEBY TECHNOLOGIES LLP. If your course is free, you may not charge students for any other products or services related to your course.

c. Content Ownership: You retain ownership of the content you create for your course, subject to the license granted to CADUCEUS WEBY TECHNOLOGIES LLP in Section 6 below.

d. Refunds: You agree to issue refunds to students who request them in accordance with the refund policy set forth in Section 6 C above.


9.Student Terms
If you are a student who uses EkaLoveYa to access courses, you agree to the following terms:

a. Course Access: You may access courses on the LMS for the fee specified by the instructor. You may only access the course for the duration specified by the instructor.

b. Payment: You agree to pay the fees for the courses you enroll in, as specified by the instructor. You are responsible for all charges associated with your account.

c. Refunds: If you are dissatisfied with a course you have purchased, you may request a refund within the refund period specified by the instructor. Refunds will be issued in accordance with the instructor's refund policy.

d. Content Usage: You may access the content of courses solely for your own personal, non-commercial use. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store or transmit any of the content on our LMS, except as follows:

e. User Content: You may submit feedback, comments, questions, or other information ("User Content") to EkaLoveYa. You agree that User Content will be considered non-confidential and non-proprietary, and that CADUCEUS WEBY TECHNOLOGIES LLP may use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Content in any media formats and through any media channels.

10.Termination
CADUCEUS WEBY TECHNOLOGIES LLP may terminate or suspend your access to the LMS, including without limitation your user account, at any time and for any reason. You may also terminate your user account at any time by contacting EkaLoveYa customer support. Upon termination, you will lose access to any courses you have enrolled in and any content you have created.

11.Disclaimer of Warranties
THE LMS IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION ANY WARRANTY OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ANY OTHER WARRANTY ARISING UNDER THE UNIFORM COMMERCIAL CODE, USAGE OF TRADE, COURSE OF DEALING, OR OTHERWISE. CADUCEUS WEBY TECHNOLOGIES LLP DOES NOT WARRANT THAT THE LMS WILL MEET YOUR REQUIREMENTS OR THAT ACCESS TO THE LMS WILL BE UNINTERRUPTED OR ERROR-FREE.

12.Limitation of Liability
IN NO EVENT WILL CADUCEUS WEBY TECHNOLOGIES LLP BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE LMS, INCLUDING WITHOUT LIMITATION LOST PROFITS OR REVENUES, COSTS OF REPLACEMENT GOODS, LOSS OR DAMAGE TO DATA, OR INTERRUPTIONS OF SERVICE, WHETHER ARISING UNDER CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR ANY OTHER THEORY OF LIABILITY, EVEN IF CADUCEUS WEBY TECHNOLOGIES LLP HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL CADUCEUS WEBY TECHNOLOGIES LLP'S LIABILITY UNDER THESE TERMS EXCEED THE AMOUNT PAID BY YOU TO CADUCEUS WEBY TECHNOLOGIES LLP DURING THE SIX MONTHS PRIOR TO THE EVENT GIVING RISE TO LIABILITY.

13.Indemnification
You agree to indemnify, defend, and hold harmless CADUCEUS WEBY TECHNOLOGIES LLP and its officers, directors, employees
